Mediation in Property, Estates & Business - A Better Way

In this article, we're going to look at meditaion as a low-cost option for resolving disputes across Business, Estates and Property.

What is Mediation?

Mediation is a structured, interactive process for resolving disputes, either within families or business. With mediation, an impartial third party supports the disputing parties to resolve their conflict through the use of specialized communication and negotiation techniques. All participants in mediation are encouraged to participate in the process actively.

Mediation takes exceptional skill. Here at METTLaw, we have that skill in abundance. We have an intimate understanding of the practical, emotional and other psychological drivers behind disputes and the kind of solutions that can be achieved.

How does Mediation work?

Our main aim will be to help you to avoid the cost, time and hassle of litigation. Working together, we’ll prepare our best case for mediation. We’ll also advise you as to how should respond to any offers made by the ‘other side’.

A mediation rarely lasts more than a few hours, although, in more complex scenarios, they can last a few days.

Property mediation

Mediation is often the most effective way to resolve almost any property dispute. As experienced legal professionals, we’ll use our know-how and innovative thinking to resolve yours – quickly, empathetically and efficiently.

Whether it’s personal or for business, we’ll use our background in the worlds of property and law to bring a fast and fair resolution to your legal dispute.

We enjoy a full understanding of the technical and legal issues that surround property. We’re especially skilled when it comes to matters of inheritance of estates.

Disputes with neighbours

Have you found yourself in dispute with the owner of a neighbouring property or piece of land? Are you looking for an experienced property mediator to help you resolve the dispute?
We’ll help with any of these issues -

  • Rights of way - extent, use, changes, interference
  • Party walls and building work problems
  • Boundaries and adverse possession
  • Rights of light or other easements
  • Neighbour disputes
  • Restrictive covenants
  • Drainage issues

… and more.

Mediation in inheritance – the benefits

Mediation has an important role to play in the field of inheritance disputes These can be particularly unpleasant -

Time – Parties can decide to go to mediation at any point in a dispute. A case from start to finish could take up to 18 months or even longer. Litigation can be very stressful for all parties involved and mediation could assist with a settlement much earlier on. Mediations often settle on the day or shortly afterwards.

More Control – Taking your inheritance dispute to mediation means you’ll have more control over the terms of the agreement. At trial, it’s the Judge who decides on the outcome.

Lower Costs – There are costs involved in mediation, but they’re far lower than those involved if your dispute goes to court. Bear in mind that mediation doesn’t guarantee you the best financial settlement. However, the money saved on court costs may well give the best result in the long run.

Mediation in business

We are experienced and knowledgeable at mediating across all kinds of business disputes. This includes resolution and negotiation of shareholder, board, contract and commercial disputes. Here are just a few instances -

  • Contract claims
  • Debt and disputed debt claims
  • Directors’ duties
  • Family business
  • Injunctions and other interim relief
  • Insolvency
  • General business regulatory
  • Professional negligence
  • Sale and supply of goods and services
  • Shareholder and company disputes

Are you a Company Director, a Shareholder, or an employee? Whatever the nature of your dispute, we’ll use our experience at mediation to bring it a satisfactory conclusion.
